New for video surveillance at work: Here’s what’s changing

That of video surveillance is an issue of increasing interest to more and more people.

According to the “1st Report on the Security Supply Chain in Italy” conducted by the Censis Foundation and Federsicurezza, it represents a sharply growing sector: in fact, the past decade has seen an increase in demand
of installation of security and video surveillance systems by companies and individuals.

Security or privacy? However, when it comes to video surveillance in workplaces, there is a strong debate that
contrasts the needs of security and prevention of theft and breaches by companies with the protection of privacy
Of its employees. So if you are running a business and you consider a good video surveillance system to be essential, then you should consider it equally important to respect the rights of the worker, to protect his or her confidentiality
And its dignity.

To ensure this, interpellation petition No. 3 dated May 8, 2019 was issued by which the Ministry of
Labor and Social Policy introduces an important innovation for cameras installed in workplaces.

What changes?
If the rule of silence-consent used to apply, now this is no longer sufficient. Under the old regulations provided
by L. no. 241/1990 to be able to install video surveillance equipment or control instruments to the work activity
the silence of the relevant administrator was sufficient, which then counted as implied permission.

With interpellation 3/2019, however, the administrative authorization of the Territorial Labor Inspectorate (ITL) becomes necessary. The interpellation originated as a response to the petition filed by the National Council of the Order of Labor Consultants asking for more attention to be paid to the protection of workers by regulating the practice of silence-consent and thus preventing improper and unjustified monitoring of labor activity.
